1. General
1.1 Parties to the agreement. You and BIKES4RENT are the sole parties to this Agreement. You are the sole user of the Services and thus you are solely responsible for complying with all terms and conditions described in this Agreement.
1.2 You declare and confirm that you are at least 18 years old.
1.3 You hereby declare and confirm that you are physically fit and competent to operate the bike. You assume all responsibility and risks for injuries or health conditions when you choose to operate the bike.
You are solely responsible for determining your general ability, health condition, weather conditions, including and without limitation rain, fog, snow, hail, ice, heat or electrical storms and / or other factors that may pose any risk by operating the cycle. You have understood that depending on the weather, traffic or any other circumstance, uncertainty or other factors you need to adjust, adjust and calculate your speed, driving behavior and braking distance.
1.4 Bikes4Rent has the exclusive ownership right to the services. You agree that the services, such as the bicycle or bicycle, the website, information, including all associated intellectual property, provided and made available by BIKES4RENT, will at all times remain under BIKES4RENT exclusive ownership and that you may not use BIKES4RENTs in any way exclusive property for commercial or other purposes without BIKES4RENT's written consent.
1.5 The availability of services. All types of bicycles are rented. pr. Whole day.
1.6 In order to use the services and operate one of our bicycles, you must agree to only operate and store the given bicycle within the area of use Skagen & surroundings (50km radius of Bikes4Rent). If a BIKES4RENT is carried on the ferries and/or outside the given radius, BIKES4RENT regards the given bicycle as stolen and will charge a compensation fee of up to DKK 26,000.00, depending on the type of bicycle.
1.7 You agree to comply with local laws and regulations regarding operating the bicycle. You agree to operate the bicycle in accordance with any applicable laws, regulations and rules relating to the operation of the bicycle in Denmark. You understand that you are solely responsible and liable for any violation of laws, regulations and rules while using the Services and operating the Bicycle.
1.8 Restrictions, limitations and safety measures while operating a bicycle
You agree not to operate the Bicycle while carrying any items that may impair your ability to safely operate the Bicycle, including but not limited to backpacks, bags, briefcases or packages.
You are not permitted to carry another person, a child or an animal on the bicycle.
While riding the bicycle, you must not use any mobile device, including, but not limited to, telephones, text messaging devices, media players, or other devices that may distract you or prevent you from operating the bicycle safely.
You agree not to operate the bicycle while under the influence of alcohol, drugs, medication or other substances that may impair your ability to operate the bicycle safely.
During the rental period, you are responsible for keeping the bike safe and locked if it is not in use.
BIKES4RENT recommends that you wear a CE approved (or higher standard) helmet. Can be rented BIKES4RENT.
You agree that you will not use the bike for competitions, races or similar events, including both professional and non-professional stunt or trick riding.
You agree that you will not operate the bicycle on unpaved roads, in mountainous terrain, through water and/or lakes or in any place where it is prohibited, illegal and/or a nuisance to any third party.
1.9 Unauthorized use, tampering and hacking
You may not tamper with, attempt to gain unauthorized access to, modify, hack, repair any of BIKES4RENT's material property or hardware, source codes, information, including the website and the bicycle regardless of purpose. The website and the bicycle may only be used for purposes consistent with this agreement.
1.10 Reporting of incidents
You must report any incident, accident, material damage, personal injury, stolen or lost bike to BIKES4RENT as soon as possible.
If the accident involves third-party personal injury, property damage, or any other third-party damage, then report the incident to the local police department as soon as possible. This also applies if the bicycle is stolen during the rental period.
1.11 Lost or stolen bicycles
You must immediately report to BIKES4RENT if the bike is lost or stolen.
BIKES4RENT and you agree that at all times it is the person renting the bike who is obliged to pay the deductible (up to DKK 6,000.00, depending on the bike) in case of loss of bike without associated keys or the full amount of the bike (up to DKK 26,000.00 including extra equipment. Depending on equipment and type of bike) in case of loss of both bike and associated keys.
1.12 Liability for damages
You agree to return the bike to BIKES4RENT in the same condition as it was rented. You will not be held responsible for normal wear and tear.
You agree that you are responsible and liable for any and all abuse, consequence, claim, cause of action, loss, liability, property damage, personal injury, expense and cost, penalty or payment of any kind or type related to a stolen or lost bicycle.
1.13 Electric vehicle
By renting an electric bicycle, you acknowledge that the bicycle is an electric vehicle that needs to be handled safely and with care, as it is an electronic product. You acknowledge that the Bicycle needs periodic charges to function. You understand and agree to each of the following points:
The remaining battery level in the bicycle decreases as the bicycle is operated and the performance capacity and speed may decrease or stop completely as the battery level decreases.
The rate at which the battery level decreases may vary and differ from time to time due to various factors such as condition of the bike and battery, weather conditions, road conditions and/or other varying factors.
It is your responsibility to check the battery level in the bicycle to ensure that it is sufficient before operating the bicycle.
Any distance, speed and/or time that you can operate the bike at or for before the power level is zero is not guaranteed by BIKES4RENT in any way. BIKES4RENT does not guarantee that the bike will not run out of power during your rental period.
2. PAYMENT AND FEES
2.1 Tariffs
Your rental of the bicycle is calculated on the basis of the selected rental period via the website. BIKES4RENT will debit your deposit, your credit card or other agreed payment methods with the amount that appears in the booking system on the website. Unless otherwise stated, all monetary values described in this agreement are deemed to be stated in Danish kroner.
2.2 Charges and rental periods
A rental period is 24 hours. It is possible to book and pay for the rental of a bicycle for several consecutive or separate periods of 24 hours. You agree to hand over the bike within the agreed rental period. If the bike is not delivered on time, BIKES4RENT considers the bike to be stolen and you will be charged a compensation fee of up to DKK 26,000.00 (Based on indicative price per type of bike rented from new).
2.3 Payment methods
You must provide BIKES4RENT with information and information to validate payment cards for registration to use the services. You represent and warrant to BIKES4RENT that you are authorized to use any payment card information that you provide. You authorize BIKES4RENT to charge the specified card for all payments you are charged. All charges are subject to relevant taxes and other local government charges that BIKES4RENT may collect and collect.
3. DISCLAIMER, LIMITATION OF LIABILITY AND ACCEPTANCE OF RISK
3.1 Disclaimers
You hereby acknowledge and agree that your use of the service and operation of the bicycles is at your own risk. BIKES4RENT provides the services without any guarantees whatsoever in relation to the services.
You hereby understand and acknowledge that the Services may present you with inaccuracies, such as, but not limited to, that the Bicycles may be in any condition and may not function smoothly.
3.2 Limitation of liability
You hereby acknowledge and agree, subject to applicable law, that BIKES4RENT is not responsible or liable for any claim arising out of or in connection with your use of or inability to use the Services, a breach of this Agreement or your breach of any law while using the Services (bike and website).
3.3 Your acceptance of risk
You are single-handedly or fully responsible for the safe operation of the bicycles at all times. You agree that the bicycles are electrical machines that may malfunction, even if the bicycle is properly maintained, and that such malfunction may cause personal injury. You agree that riding a bicycle involves many obvious and hidden risks and dangers that may result in personal injury or death, as well as property damage, and that such risks and dangers cannot always be predicted or avoided. You agree that such risks and hazards are your sole responsibility, including, but not limited to, choosing whether to wear a helmet as required by local law or to use protective equipment.
You agree that if your use of any of the Services causes injury to other persons or property, then you may be held liable for all resulting damages to persons and property and related costs. By choosing to operate a bicycle, you assume full responsibility for all related risks and dangers and you agree that BIKES4RENT shall not be liable for any injuries to persons or property or costs caused by you in respect of any person or property, including the bicycle itself.
3.4 Replacement
You agree that if your use of any of the Services causes injury to other persons or property, then you may be held liable for all resulting damages to persons and property and related costs. By choosing to operate a bicycle, you assume full responsibility for all related risks and dangers and you agree that BIKES4RENT shall not be liable for any injuries to persons or property or costs caused by you in respect of any person or property, including the bicycle itself.
3.5. Insurance
BIKES4RENT's bicycle is covered by statutory liability insurance in accordance with §105 of the Norwegian Road Traffic Act. The insurance is valid for 2021 and covers the bikes that BIKES4RENT has announced are active on the street. Should you need to show documentation that liability insurance has been taken out to the police while driving, you can find documentation under our FAQ.
4. PRIVACY
By using the services, you acknowledge and accept that BIKES4RENT uses your personal information in accordance with BIKES4RENT's Privacy Policy, which is made available at www.Bikes4Rent.dk.
5. TIME PERIOD AND CANCELLATION
5.1 Time period
The time period for this agreement comes into force between you and BIKES4RENT from the first booking and payment you make on the website and is valid for as long as you use the services provided by BIKES4RENT. The time period ends 10 years after your last use of the Service.
5.2 Cancellation of contract
It is not possible to cancel a booking and/or payment for bike hire. It is not possible to get a refund. BIKES4RENT can at any time and for any duration unilaterally withdraw your right to use the services without your consent and without notice or justification.
6. DISPUTES
Any and all disputes relating to this Agreement must be submitted in writing to the contact information provided in Article 7 below.

8. GOVERNING LAW AND JURISDICTION
You agree that any dispute arising out of or in relation to the agreement, breach of it or its content, unless otherwise required by a prescriptive law in any other jurisdiction, will be dealt with under Danish law and decided exclusively by Danish courts.
9. FINAL AGREEMENT AND MODIFICATIONS
You acknowledge that this Agreement contains the complete, final, and exclusive entire agreement between the parties with respect to its subject matter. This Agreement supersedes all prior agreements, written or oral, relating to its subject matter. At any time and from time to time, and without your consent, BIKES4RENT may unilaterally add to, modify or change this agreement based on its sole discretion and without prior notice or reason.
By continuing to use any Service after any addition, modification, or change, you agree to be bound by any such addition, modification, or change. You should carefully review this Agreement periodically to maintain an understanding of any additions, modifications, or changes. The pricing stated on BIKES4RENT's website supersedes all pricing stated in this agreement.
10. INTERPRETATION AND VOLUNTARY ENFORCEMENT OF THIS AGREEMENT
You acknowledge that the headings in this Agreement do not affect the interpretation of this Agreement. "Or" should not be understood exclusively. "Including" means "including but not limited to".
You acknowledge that you have voluntarily read this Agreement, have understood the terms and consequences of this Agreement, and are fully aware of the legal and binding meaning of this Agreement.
